These are a comprehensive set of notes covering all the topics in the Trusts course at Monash University. I provide a succinct summary of the general legal principles, citing the relevant legal authority, and give a detailed yet succinct summary for each case. I also include some cases not cited on the usual university reading guide, but are referred to in past exams, giving you the maximum opportunity to impress in your answer and achieve the best result. Good students have clear notes that make sense to them. Trusts was my favourite unit I ever did. I put so much work into it and absolutely nailed the final exam (98%) and all internal assessments.
Topics covered include the 3 Certainties, Quistclose Trusts, Charitable Trusts, Statutory Writing Formalities, Trustee Duties, Defences and Limitations on Liability (Armitage Clauses), Right of Indemnity, Tracing and MORE!
I am a final year Law/Arts student at Monash, pursuing a clerkship at a top tier international law firm in July. Over the years I’ve perfected the art of writing good law notes, and I really hope these will help you out!
